A summary offense may not rank as a misdemeanor or felony criminal activity. But you cannot simply disregard the citation. This can result in an arrest; fines; the suspension of your driver’s privileges; and up to 90 days in jail. You may not feel as though anything you did was extreme or destructive enough to warrant such punishments, but the law will not be ignored.
When you receive a summary offense notice:
- You typically have 10 days to respond with either a guilty or not guilty plea. Regardless of the position you take, you will be required to provide money to the magistrate.
- In cases where you are pleading guilty, you will provide the money to pay the fine associated with the infraction and may incur other penalties. Such as points on your license or suspension of your license.
- In cases where you are pleading not guilty, you will provide either the total amount of the fine or a $50.00 minimum deposit – or security fee – to the magistrate to secure the time and date of your hearing.

As an attorney, one of the first things I review is the section of the law and city codes that are alleged to have been broken. If the officer failed to list the appropriate charge under the appropriate section of law that has been violated, your citation may be found invalid. That can result in a full dismissal of your charges along with any obligations to the fines and/or other penalties listed on the citation.
If you are facing a proceeding before a magistrate, call or stop by my firm for a free evaluation of the details of your case. I may be able to help you avoid costly fines and even jail time. Pick up the phone today!
