- Follow No Contact orders. This means no visits, phone calls, text messages or emails. Even if the accuser calls you and asks you to return, or you need to stop home to retrieve a few possessions, violating this order will result in harsher penalties.
- If an alleged victim changes his or her mind and wants to drop charges, prosecutors will still file charges and put it in the court’s hands to decide.
A domestic violence attorney will investigate all the circumstances surrounding the arrest. The alleged victim may have been the primary attacker, prompting self-defense. It takes only a split-second decision to shove or scratch someone, to trigger an arrest. The accuser may have been intoxicated or may have a history that will influence the case in the eyes of the court. I look into all of these factors.
